CHARGEBACK ABUSERS:

Fraudulent consumer purchases create costly chargeback’s for merchants. In the event that a charge-back is placed on a purchase, we reserve the right to report the incident for inclusion in a charge-back abuser database. Information reported will include name, email address, order date, order amount, IP address, full address, and phone number. If you initiated a charge-back there will be a $25.00 service fee for each charge-back initiated plus money owed to merchant, in addition charge-back abusers wishing to be removed from the database shall pay a $100.00 processing fee. We will only accept payment from a U.S. Postal Money Order. All bad checks and fraudulent purchases will be turned over to any of the following: County District Attorneys Office, Small Claims Court, U.S. Postal Mail Fraud Division and Collection Agencies this action may adversely affect your credit rating. Shipping and Gourmet Selection Wholesale Truck Delivery Guarantee:

Gourmet Selection Wholesale L.L.C. Guarantees your package will arrive in perfect condition to the address stated on your order if shipped according to shipping directives (see perishables policy below). This excludes orders for which we are given incorrect or incomplete addresses. Shipping time does not include the day the order was placed, or weekends and holidays. (See order acceptance below). Shipping method: UPS or FedEx 2nd day air or overnight. Express shipments allow 3-5 business days. We do not ship to P.O. Box, APO or FPO. Gourmet Selections Wholesale L.L.C. is not responsible for packages lost, stolen or otherwise missing. Shipping carrier may deliver package to the curb or to the door depending on the size and weight of the package. All perishable shipments are processed Monday through Wednesday in most cases to prevent an order from sitting in the shipping carrier’s hub during the weekend.

Once the E-mailed or faxed, Ordering Form/Verification Signature Sheet, sent to you from our processing center has been signed and returned to us by the customer of order and customer has received an invoice number, the order is then in the confirmed process phase. Once an order is in the confirmed process phase it is finalized, an order is placed. Once a finalized order is placed, it goes out to the order fulfillment center for shipping and we cannot stop it. There is no cancellation of an order once it has been placed.

Some orders may not require the ordering form/verification signature sheet. All customer orders are considered finalized and placed at the time of payment. This policy is in place due to the nature and type of perishables to be shipped. Preparation and limited time frame requirements for shipping carriers must be met.

You, the (customer), will be required to authorize/acknowledge that any adult who signs for the package delivered to your home, office or FedEx/UPS official package acceptance center by couriers will be held equally liable for the acceptance of the package and terms/conditions of this transaction. Any adult accepting and signing for the package in the final delivery phase, with your authorization/acknowledgement satisfies requirements for a completed delivery. Majority of orders will receive an E-mail notification once the package has arrived. In conclusion this will complete, (Gourmet Selections Wholesale L.L.C.) liability of delivering your order.

Standard delivery couriers: Orders under $150.00 will be shipped as standard delivery with tracking, unless customer requests a signed delivery confirmation. You, the (customer), will be required to authorize/acknowledge that once courier-tracking notification shows that the package has been delivered, then this alone satisfies and completes (Gourmet Selections Wholesale L.L.C.) liability agreement of delivering your order in its entirety.

Shipping to an Address Other Than Your Billing Address:

If your order is shipping to an address other than the billing address on your credit card, we may contact you to list the alternate address with your credit card company. Your order will not be processed until your payment has been confirmed. This helps prevent fraudulent use of your credit card. To list the alternate address with your credit card company, just call the 800 number on the back of your card and ask the agent to add the address to the notes on your account. Listing the address before you place an order helps us process your order more quickly.

Availability:

All orders are subject to availability. We make every effort to keep our online inventory up to date. Prices and products are subject to change. If an item you ordered is out of stock, we will notify you. Your order will not ship until we hear back from you.

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. For your convenience, you will not be charged until your payment method is authorized and the order information is verified for accuracy. On certain orders at our discretion, when applicable, you will be charged once the order has shipped or had been scheduled for Gourmet Selections Wholesale truck local delivery .

Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verification’s or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge.

DAMAGED GOODS:

If your product arrives damaged, please retain packaging and notify us immediately. If it is determined, that the product was damaged in transit, a claim form will need to be filed with the carrier and customer may be required to take photographs of the damaged item.

Carefully inspect the outside of the boxes and note any marks, indents, crushing, tearing, or punctures on both copies of shipping receipt. This notation provides an early indication and proof that damage may be present. Please review shipping receipt. To guarantee that your shipment has no concealed damage, you may open boxes while the driver is there, if time permits. Notate in writing, any damage discovered directly on your shipping receipt. By signing the Bill Of Lading or Delivery Receipt, you are stating that the shipment was received in good condition. Freight companies will rarely honor a claim if damage is not noted on the delivery receipt. If damage is discovered after opening boxes, please notify us immediately, and we will assist you with filing a claim. Please take photo(s) of damage and retain product and packaging for inspection. Claims for concealed damage must occur within 15 days of shipment origin date.

SHIPPING RETURN POLICY / CUSTOMER LIABILITY:

We take great pride in our work and offerings to our customers. We want you to be satisfied with your purchase, and understand that web shopping entails making purchases sight unseen. If you are unsatisfied with your purchase, you may return your unused product by contacting us within 7 days of receipt for a no hassle return, with authorization. However, unless and until the product is returned, no credit is due. You will need a Return Authorization Code Number. Returns must be received in new condition with original packaging intact. Dry ice must be added to the container, filled to the top and must be shipped overnight. Additional charges will be applied if the delivery address is incorrect or if the package needs to be forwarded to a different address.

Refunds will be processed, less original shipping and handling costs. Items returned without original packaging or in conditions other than new, may be refused and/or subject to a restocking fee of up to 25%. Original shipping charges, and overnight shipping expenses incurred to return the product are the responsibility of the customer. Customer that refuses a shipment or a Gourmet Selections Wholesale truck delivery, at the time of the scheduled delivery, or if no one is present for the delivery and after maximum attempts for re-delivery has been attempted by the courier, the customer will be held responsible for original and return shipment costs. Including any damage of the product occurring during transit and returned to Gourmet Selections Wholesale L.L.C., as well as a restocking fee up to 20%. This information applies to shipping a finalized and place order and Gourmet Selections Wholesale LLC local scheduled truck delivery.

Orders returned without a Return Authorization Code Number will be refused. Returns after 14 days from Return Authorization date are not accepted. All sales final after 30 days. Package should be insured and shipped overnight via a trackable carrier method; we cannot provide credit or replacement for packages lost during shipping.
